This letter concerns barriers to accessibility on the website daltoninvestments.com, which Dalton Investments LLC operates in connection with an investment-advisory office. On the date noted above the website was evaluated for conformance with the Web Content Accessibility Guidelines and found to be non-conformant with WCAG 2.1 Level AA, WCAG 2.2 Level AA, and Section 508.

The evaluation followed the W3C Website Accessibility Conformance Evaluation Methodology using three independent testing engines, and identified 27 standards-mapped accessibility failures across 3 WCAG Success Criteria — including Info and Relationships (WCAG 1.3.1); Name, Role, Value (WCAG 4.1.2); Contrast (Minimum) (WCAG 1.4.3). These barriers impede people who rely on screen readers, keyboard navigation, or magnification. Each failure is itemized, with a preserved screenshot of the failing element, in Exhibit A enclosed with this letter. All evidence was cryptographically sealed at the time of capture and is independently verifiable.

Title III of the Americans with Disabilities Act, 42 U.S.C. §§ 12181–12189, requires the full and equal enjoyment of the goods and services of a place of public accommodation, and courts apply WCAG as the measure of an accessible website. This matter is also governed by the Unruh Civil Rights Act, Cal. Civ. Code §§ 51–52.

Accordingly, within 45 days of this letter, please (a) remediate the website so that it conforms to WCAG 2.1 Level AA; (b) confirm the remediation in writing; and (c) preserve all electronically stored information relating to the website, including source code and version history, as this matter may result in litigation.
